First and foremost “Carlos Mencia” is actually NED HOLNESS. His father is GERMAN and his mother is HONDURAN. No Mexican in him period, end of story. FYI: In an HBO Comedy special, “Carlos” also stole 13 minutes of Material from George Lopez. Lopez’ lawyers contacted HBO and HBO pulled the special. He stole a bit from Bill Cosby and Sam Kinneson.
There is a difference between just telling a joke and saying that the joke is yours. You can tell someone about some scientific research. If you took that same research and wrote it up, trying to pass it as your own, that’s plagerism. He’s making money from other people’s works and not crediting them (actually, he denies he steals stuff). His comedy specials are copyrighted and if you copyright someone else’s previously copyrighted work, that’s illegal.
Jokes, bits and routines are intellectual property. Stand up comics do yourselves a favour and protect your material. You can 100% legally, and fully enforceable. Stealing material is wrong. It is bad enough when comics on the circuit etc, do it, but when the thief has mega exposure, the victim’s own career declines automatically, and then must work much harder just to maintain work, let alone progress. The best bits the victim had, which may have taken years to produce, are now unavailable to him. Then the vicious circle continues. Victim devotes time producing new work, instead of honing his best work. It gets ripped again, and victim slides backwards further, while hack grows fatter, with less effort. The cycle for thief continues unabated until called out.
If the Hack did not want to be called a hack and a thief, then do the right thing. Do what artists in other disciplines do- CREDIT the bits you “borrow”, at least, and pay for the right to do it. If using other people’s work is “no big deal”, then why not credit and pay?
Because the payoff IS the credit.
To answer Pam’s (#6) question, the dude IS Mexican, that’s why! He may have been born in Honduras and raised in East L.A., but his mom was born in Mexico and his dad in Honduras, so how the hell is he not Mexican, too? And BTW, everybody knows his birth name’s Ned. Just look him up on any bio anywhere and it’ll tell you that. He legally changed it to Carlos, though, so he’s technically no longer Ned, so why the heck do people still call him that? Oh, and this whole half-German thing that I’m hearing now, where does that come from? Honduran father + Mexican mother = Honduran kid raised in America … how the hell does that constitute German at all?!?! Am I missing something here?
